Velvet Memories (a DBA of Fix and Future Remodeling) operates an online store selling personalized magnets and related goods. By accessing or using our website and placing an order, you agree to these Terms of Service and our Privacy Policy.

1. Eligibility

You represent that you are at least the age of majority in your jurisdiction. By placing an order you confirm you have the legal right to enter into binding contracts.

2. Orders & Order Acceptance

All orders are subject to acceptance by Velvet Memories. We may refuse or cancel any order for any reason, including product unavailability, errors in product or pricing information, suspected fraud, or difficulties verifying your payment method. If we cancel an order after payment, we will notify you and issue a refund where applicable.

3. Custom / Personalized Products — Final Sale

Because our products are custom-made and personalized, all sales are final once production has begun. Exceptions are limited to (a) manufacturing defects, or (b) demonstrable errors on our part (e.g., wrong photo printed). See our Returns & Refunds section.

4. Cancellations

Orders may be cancelled free of charge only within 12 hours of purchase. After that period production may begin and cancellations or refunds will not be available. To request a cancellation, email: velvetmemories.store@gmail.com with your order number immediately.

5. Prices, Payment & Taxes

Prices displayed are in USD and exclude applicable sales tax and shipping unless stated otherwise. Payment is required at the time of order. You are responsible for any taxes, duties, or fees assessed by your local jurisdiction.

6. Shipping & Delivery

We ship via USPS. Typical processing time is 2–4 business days before shipment. Once shipped you will receive tracking information; allow up to 24 hours for tracking to activate. Estimated transit times: Continental U.S. 2–3 business days; Alaska/Hawaii up to 4 business days; U.S. territories up to 7 business days. Velvet Memories is not liable for delays caused by carriers or events beyond our control.

7. Returns & Refunds

  • To request a review for a defect or an order error, contact us within 7 days of delivery at velvetmemories.store@gmail.com.
  • Items must be unused and returned in original packaging when requested.
  • If we approve a return or replacement, we will provide instructions. We reserve the right to deny claims that are not supported by evidence.
  • Except as stated above, refunds are not available for custom or personalized items.

8. Intellectual Property

All site content, logos, product images and text are owned or licensed by Velvet Memories. You may not reproduce, distribute or create derivative works without our prior written permission.

9. User Content & Submissions

If you provide images, text, or other materials for personalization you warrant that you own or have the right to use them and that they do not infringe third-party rights. By submitting material you grant Velvet Memories a non-exclusive license to use it for order fulfillment and marketing purposes as described in our Privacy Policy.

10. Prohibited Uses

You agree not to use the site for unlawful purposes, to upload malware, infringe intellectual property, post defamatory content, or interfere with site security.

11. Disclaimers; Limitation of Liability

To the fullest extent permitted by law, Velvet Memories provides products and the site “as is” and disclaims all warranties, express or implied. Velvet Memories will not be liable for incidental, consequential, special, or punitive damages arising from your purchase or use of our products. Our liability for any claim will be limited to the purchase price of the product at issue.

12. Indemnification

You agree to indemnify and hold Velvet Memories, its affiliates, officers and employees harmless from any claim, loss, liability, demand or expense arising from your breach of these Terms or your submissions.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute will be brought in state or federal courts located in Texas.

14. Changes to Terms

We may modify these Terms at any time; changes will be posted on the site with an updated effective date. Continued use after changes constitutes acceptance.

15. Severability & Entire Agreement

If any provision is unenforceable, the remainder will remain in effect. These Terms, together with our Privacy Policy and any order confirmations, constitute the entire agreement between you and Velvet Memories.
